Why is Elon Musk’s X Suing California?
On 8 September, X took legal action over content moderation law AB 587 of the state of California, signed by Governor Gavin Newsom in September 2022. According to this law, it is mandatory for all social media platforms to disclose and provide clear information about their content moderation policies and terms of service.
Furthermore, they are also required to submit a semiannual report outlining details about their definitions of extremism, foreign political interference, hate speech, harassment, and misinformation according to their present terms of service. This report must also contain how they are going to handle and moderate all of the mentioned terms.
X Corp. has taken legal action against AB 587’s content moderation policies, stating that it violates its “freedom of speech” law. Plus, this law is trying to force companies to say things they don’t want to say and is getting in the way of their freedom to make decisions about what type of content is allowed to be published or shared on their platform.
Jesse Gabriel, the author of AB 587, made a statement about the mentioned law that it does not force companies to use any particular rules for controlling content. Instead, AB 587 is just about making sure that companies are clear and honest about how they control what people say or post on their platforms.
He further said the law is just about being open and honest, so if Twitter is already doing things right, then they should have no objection to this bill.
